Eligibility

You must be at least 13 years old, or older if the law where you live requires it, to use Seep. If you're under 18, or under the age of majority where you live, you need a parent's or guardian's permission, and they agree to these terms for you.

Accounts

Seep creates an online account for you the first time it goes online, without an email address or password. If you sign in to Game Center or Google Play Games, your account is linked to it and follows you to new devices; otherwise it stays with that install of the app, and may be lost if you delete the app or change devices.

Your account is personal to you. You may not sell, transfer or share it, or use someone else's. You're responsible for activity on your account and for keeping your device and Game Center or Google account secure.

You can delete your account at any time in the app under Settings → Delete account. Deletion is permanent.

Played for fun

Seep is a game of skill played for entertainment. No real money is staked, won or lost, and there are no cash prizes. Ratings, tiers, stats, leaderboard places and avatars have no monetary value and can't be sold, traded or exchanged for money or anything else.

Online play

• Find Players matches you with other players.
• Leaving an online game, or still being disconnected when your turn runs out, forfeits it, and it counts as a loss. If you don't play within the turn time, Seep plays a card for you.
• Games in private rooms with friends don't affect ratings or leaderboards.
• We may correct ratings, stats and leaderboards to fix errors or undo the effects of cheating or abuse, and we may change how ratings, tiers and leaderboards work.
• Online play depends on our servers and your internet connection. It may be unavailable at times, for example during maintenance, and older versions of the app may need updating before they can play online.

User conduct

You agree not to:

• cheat, including by using modified versions of the app, bots, scripts, or other automation;
• exploit bugs, or collude with other players, deliberately lose, or abandon games to change your own or anyone else's rating or leaderboard place;
• use a display name that is offensive, hateful, sexual, misleading, impersonates someone else, or advertises anything;
• harass or abuse other players;
• copy, modify, reverse-engineer, or interfere with the app, our servers, or other players' games, or access them by any means other than the app; or
• use Seep in any way that breaks the law.

If you break these rules, we may, without notice, change your display name, reset your stats, rating or leaderboard places, or suspend or delete your account. If you think we've made a mistake, email [email protected].

Tips and ads

Seep is free to play and supported by ads. Tips are optional in-app purchases that support Seep's development. Any tip also removes ads from Seep for the Apple or Google account that bought it; use Restore Purchases to restore this on another device signed in to the same account.

Tips are processed by the Apple App Store or Google Play under their terms, and we never see your payment details. Tips are final, except where the law gives you a right to a refund. Refunds are handled by Apple or Google.

Ads are provided by third parties. We aren't responsible for advertisers' products, services or websites.

Proprietary rights

Seep, including its software, design, artwork, avatars, text and the seep.app website, is owned by us or our licensors and protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial entertainment. You may not copy, sell, rent, distribute, or create works based on Seep.

Seep includes fonts and open-source software licensed under their own terms. They're listed in the app under Settings → Licenses, and those licences apply to those components.

App stores

If you downloaded Seep from the Apple App Store or Google Play, that store's terms also apply. These terms are between you and us, not Apple or Google, and we, not they, are responsible for Seep and its content.

For the iOS app: Apple has no obligation to provide maintenance or support for Seep. If Seep fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. We, not Apple, are responsible for any claims relating to Seep, including product liability, legal or regulatory compliance, consumer protection, and intellectual property claims. You confirm that you aren't located in a country subject to a US Government embargo, and aren't on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Disclaimer of warranties and liability

Seep is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, and don't promise that Seep will be uninterrupted, error-free, or available on any particular device, or that ratings, stats or leaderboard places will be kept.

To the extent the law allows, we aren't liable for any indirect, incidental, special or consequential loss, or for loss of data, ratings, stats or leaderboard places. Our total liability for any claim relating to Seep is limited to the greater of the amount you paid us in the 12 months before the claim and AUD $50.

If you're a consumer, you have guarantees under the Australian Consumer Law, and may have rights under the consumer laws where you live, that can't be excluded, restricted or modified. Nothing in these terms takes them away. Where we're allowed to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the service again or paying the cost of having it supplied again. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

Indemnity

To the extent the law allows, you agree to cover our reasonable losses and costs from third-party claims caused by your breach of these terms or your misuse of Seep, except to the extent we caused them.

Termination

You can stop using Seep and delete your account at any time. We may suspend or end your access to online play if you break these terms, if the law requires it, or if we stop offering online play or Seep. Games against the computer don't depend on our servers.

Sections that by their nature should survive termination, including Proprietary rights, Disclaimer of warranties and liability, Indemnity, and Applicable law, continue to apply.

Changes

We may change Seep, including adding, changing or removing features. We may also update these terms; we'll post the changes on this page and update the date at the top, and for significant changes we'll also let you know in the app. If you keep using Seep after a change, the updated terms apply. If you don't agree with them, stop using Seep and delete your account.

Applicable law

These terms are governed by the laws of Australia. If you have a problem with Seep, please email [email protected] first so we can try to resolve it. Disputes may be brought in the courts of Australia, and if you're a consumer, you keep any right to bring proceedings in your home country under its mandatory laws.

General

These terms, together with the Privacy Policy, are the entire agreement between you and us about Seep. If any part is found unenforceable, the rest still applies. If we don't enforce a part of these terms, we haven't waived our right to do so later. You may not transfer your rights under these terms; we may transfer ours to someone who takes over Seep. We aren't responsible for delays or failures caused by events beyond our reasonable control.
